On 18 April 2017, the Government announced that the Temporary Work (Skilled) visa (subclass 457 visa) will be abolished and replaced with the completely new Temporary Skill Shortage (TSS) visa in March 2018.

The TSS visa programme will be comprised of a Short-Term stream of up to two years and a Medium-Term stream of up to four years and will support businesses in addressing genuine skill shortages in their workforce and will contain a number of safeguards which prioritise Australian workers.

This new visa is part of the Government’s significant reform package to strengthen the integrity and quality of Australia’s temporary and permanent employer sponsored skilled migration programmes.

Key reforms include:

• Introducing the temporary skill shortage visa with new requirements, including but not limited to:
  • new, more targeted occupation lists which better align with skill needs in the Australian labour market
  • a requirement for visa applicants to have at least two years’ work experience in their skilled occupation
  • a minimum market salary rate which ensures that overseas workers cannot be engaged to undercut Australian workers
  • mandatory labour market testing, unless an international obligation applies,
  • capacity for only one onshore visa renewal under the Short-Term stream
  • capacity for visa renewal onshore and a permanent residence pathway after three years under the Medium-Term stream
  • the permanent residence eligibility period will be extended from two to three years
  • a non-discriminatory workforce test to ensure employers are not actively discriminating against Australian workers
  • strengthened requirement for employers to contribute to training Australian workers
  • the Department of Immigration and Border Protection will collect Tax File Numbers and data will be matched with the Australian Tax Office’s records, and
  • mandatory penal clearance certificates to be provided.
• Tightening eligibility requirements for employer sponsored permanent skilled visas, including but not limited to:
  • tightened English language requirements
  • a requirement for visa applicants to have at least three years’ work experience
  • applicants must be under the maximum age requirement of 45 at the time of application
  • strengthened requirement for employers to contribute to training Australian workers, and
  • employers must pay the Australian market salary rate and meet the Temporary Skilled Migration Income Threshold.
• Concessions for regional Australia will continue to be available:
  • Employers in regional Australia will continue to have access to occupations under the temporary and permanent visas, to reflect their skills needs.
  • Existing permanent visa concessions for regional Australia, such as waiving the nomination fee and providing age exemptions for certain occupations, will be retained. Consideration will be given to expanding the occupations in regional Australia that are exempt from the age requirement.
• Significantly condensing the occupation lists used for skilled migration visas, including the subclass 457 visa, from 19 April 2017.

The implementation of these reforms will begin immediately and will be completed in March 2018.

Fact sheet one: Reforms to Australia’s temporary employer sponsored skilled migration programme—abolition and replacement of the 457 visa (EXTRACT)

What is changing?

Changes from April 2017

From 19 April 2017, for the existing 457 visa:
- Occupation lists: The occupation lists that underpin the 457 visa will be significantly condensed from 651 to 435 occupations, with 216 occupations removed and access to 59 other occupations restricted.
- Of the 435 occupations, access to 24 occupations has been restricted to regional Australia (e.g. occupations relating to farming and agriculture).
- The Consolidated Sponsored Occupation List (CSOL) will also be renamed as the new Short-term Skilled Occupations List (STSOL) and will be updated every six months based on advice from the Department of Employment.
- The other occupations list used for skilled migration, the Skilled Occupations List (SOL) will be renamed the new Medium and Long-term Strategic Skills List (MLTSSL). This list will contain occupations that have been assessed as being of high value to the Australian economy and aligning to the Government’s longer term training and workforce strategies.
- A separate fact sheet about the occupation lists’ changes will be issued.
- Validity period: The maximum duration of 457 visas issued from this date for occupations that are on the STSOL will be two years. Occupations on the MLTSSL will continue to be issued for a maximum duration of four years.

Changes from July 2017

From 1 July 2017, for the existing 457 visa:
- Occupation lists: The STSOL will be further reviewed based on advice from the Department of Employment. The MLTSSL will be revised based on outcomes from the Department of Education and Training’s 2017-18 SOL review.
- English language requirements: English language salary exemption threshold, which exempts applicants whose salary is over $96,400 from the English language requirement, will be removed.
- Training benchmarks: Policy settings about the training benchmark requirement will be made clearer in legislative instruments.
- Character: Provision of penal clearance certificates will become mandatory.

Changes by December 2017

Before 31 December 2017, for the existing 457 visa:
- The Department of Immigration and Border Protection (the Department) will commence the collection of Tax File Numbers for 457 visa holders (and other employer sponsored migrants), and data will be matched with the Australian Tax Office’s records to ensure that visa holders are not paid less than their nominated salary.
- The Department will commence the publication of details relating to sponsors sanctioned for failing to meet their obligations under the Migration Regulation 1994 and related legislation.

Changes from March 2018

From March 2018, the 457 visa will be abolished and replaced with the TSS visa. The TSS visa will be comprised of

• a Short-Term stream of up to two years, and
• a Medium-Term stream of up to four years.

The Short-Term stream is designed for Australian businesses to fill skill gaps with foreign workers on a temporary basis, where a suitably skilled Australian worker cannot be sourced.
The Medium-Term stream will allow employers to source foreign workers to address shortages in a narrower range of high skill and critical need occupations, where a suitably skilled Australian worker cannot be sourced.

The Short-Term stream will include the following criteria:
- Renewal: Capacity for visa renewal onshore once only.
- Occupations:

• For non-regional Australia, the STSOL will apply.
• For regional Australia, the STSOL will apply, with additional occupations available to support regional employers.

- English language requirements: A requirement of an International English Language Testing System (IELTS) (or equivalent test) score of 5, with a minimum of 4.5 in each test component.
- Genuine entry: A genuine temporary entrant requirement.

The Medium-Term stream will include the following criteria:
- Renewal: Capacity for visa renewal onshore and a permanent residence pathway after three years.
- Occupation lists:

•  For non-regional Australia - the MLTSSL will apply.
• For regional Australia - the MLTSSL will apply, with additional occupations available to support regional employers.

-English language requirements: a requirement of a minimum of IELTS 5 (or equivalent test) in each test component.

Eligibility criteria for both streams will include:
- Work experience: at least two years’ relevant work experience.
- Labour market testing (LMT): LMT will be mandatory, unless an international obligation applies.
- Minimum market salary rate: Employers must pay the Australian market salary rate and meet the Temporary Skilled Migration Income Threshold requirements.
- Character: Mandatory penal clearance certificates to be provided.
- Workforce: A non-discriminatory workforce test to ensure employers are not actively discriminating against Australian workers.
- Training requirement: a strengthened training requirement for employers to contribute towards training Australian workers.

The detailed policy settings for several of these requirements will be finalised through the implementation process. Further details on these requirements to inform stakeholders will be available in due course.

FACT SHEET TWO: Reforms to Australia’s permanent employer sponsored skilled migration programme (EXTRACT)

What is changing?

Changes from April 2017

From 19 April 2017, for new applicants for permanent employer sponsored skilled visa programmes:
- Occupation lists: The Consolidated Sponsored Occupation List (CSOL) will be significantly condensed, with 216 occupations removed, and access to 24 occupations restricted to regional Australia (e.g. occupations relating to farming and agriculture). The CSOL currently underpins the Direct Entry stream of the ENS visa.
- The CSOL will also be renamed the new Short-Term Skilled Occupations List (STSOL) and will be updated every six months based on advice from the Department of Employment.
- The other occupations list used for skilled migration, the Skilled Occupations List (SOL) will be renamed the new Medium and Long-term Strategic Skills List (MLTSSL). This list will contain occupations that have been assessed as being of high value to the Australian economy and aligning to the Government’s longer term training and workforce strategies.

Changes from July 2017

From 1 July 2017, for permanent employer sponsored skilled visa programmes:
- Occupations lists: The STSOL will be further reviewed based on advice from the Department of Employment. The MLTSSL will be revised based on outcomes from the Department of Education and Training’s 2017-18 SOL review.
- English language requirements: A requirement of an International English Language Testing System (IELTS) (or equivalent test) score of 6 in each component.
- Age: A maximum age requirement of 45 at the time of application will apply to Direct Entry stream applicants. A maximum age requirement of 50 at the time of application will continue to apply to Temporary Residence Transition stream applicants.

Changes by December 2017

Before 31 December 2017, for permanent employer sponsored skilled visa programmes:
- The Department of Immigration and Border Protection (the Department) will commence the collection of Tax File Numbers for these visa holders, and data will be matched with the Australian Tax Office’s records to ensure that visa holders are not paid less than their nominated salary.
- The Department will commence the publication of details relating to sponsors sanctioned for failing to meet their obligations under the Migration Regulation 1994 and related legislation.

Changes from March 2018

From March 2018, for ENS and RSMS:
- For the ENS and RSMS visa: The MLTSSL will now apply, with additional occupations available to support regional employers for the RSMS.
- Minimum market salary rate: Employers must pay the Australian market salary rate and meet the Temporary Skilled Migration Income Threshold.
- Residency: The permanent residence eligibility period will be extended from two to three years.
- Work experience: At least three years’ relevant work experience.
- Age: All applicants must be under the maximum age requirement of 45 at the time of application.
- Training requirement: a strengthened training requirement for employers to contribute towards training Australian workers.

Timeline of future 457 changes are:

from 19 April 2017 - 216 occupations removed and 59 others restricted, 24 occupations restricted to regional Australia, Occupational lists renamed, validity period for occupations on STSOL 2 years.

from 01 July 2017 - English salary exemption $96,400 to be removed, training benchmarks to be changed, mandatory penal clearance certificates.

before 31 December 2017 - collection of TFN for 457 visa holders for ATO data matching, publication of sanctioned sponsors.

Timeline of future 186/187 changes are:

from 01 July 2017 - review of STSOL and MLTSSL, IELTS 6 required in each component, changes in age (DE stream 45 years old, no change to TRT).

before 31 December 2017 - collection of TFN for 457 visa holders for ATO data matching, publication of sanctioned sponsors.

from March 2018 - the MLTSSL will apply to ENS/RSMS with additional regional occupations, Market salary rate will apply and meet TSMIT, eligibility period for PR extended from 2 to 3 years, at least 3 years' work experience required, under 45 years of age, contribution towards training fund.

Note 5.    In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

a)             clerical, book keeper and accounting clerk positions;

b)             positions in a business that have an annual turnover of less than 
AUD 1 million;

c)             positions in a business that have fewer than five employees.

Note 6.    In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions related  to animal husbandry including, but not limited to, caring for livestock on a farm setting.

Note 7.    In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions related to mass or standardised production, including positions based in a franchise or factory, as opposed to specialist production. Positions excluded, but not limited to the following exclusions, are any of the following:

a)             positions that involve full or partial production of food product for distribution to another location;

b)             positions that predominantly involve the use of pre-prepared food product from another location.

Note 8.   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

a)             positions that are not located in a commercial building or shopping centre environment;

b)             positions that predominately involve the management of the provision of only one particular service to a facility or managing one particular relationship.

Example:    a position that manages the cleaning contract for a facility but not other contracts relevant to the facility.

Note 9.   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

a)             positions in a business that have an annual turnover of less than AUD 1 million;

b)             positions that have a nominated base salary of less than AUD 65,000.

Note 10: In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

a)             positions based in a front-line retail setting;

b)             positions that predominately involve direct client transactional interaction on a regular basis;

c)             positions in a business that have an annual turnover of less than AUD 1 million;

d)             positions that have a nominated base salary of less than AUD 65,000.

Note 11.  In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions involved in mass production in a factory setting and positions in a limited service restaurant.  A limited service restaurant includes, but is not limited to, any of the following:

a)             fast food or takeaway food services;

b)             fast casual restaurants;

c)             drinking establishments that offer only a limited food service;

d)             limited service cafes including, but not limited to, coffee shops or mall cafes;

e)             limited service pizza restaurants.

Note 12.  In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions that predominantly involve low-skilled tasks. 

Examples:    fruit picking or packing, feeding of livestock or animals

Note 13:  In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

a)             positions that predominately involve hair dressing and/or beauty therapy related non-managerial tasks; or

b)             positions in a business that employ fewer than five employees.

Note 14:  In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

a)             non full-time positions;

b)             positions that are not based in a therapeutic setting;

c)             positions involving the provision of  non-medical relaxation massage.

Note 15:   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

a)             positions that are based in a front-line retail setting;

b)             positions that are based in a call centre and do not require a significant technical knowledge of products;

c)             positions that predominantly involve selling educational courses to individual students;

d)             positions that have a nominated base salary of less than AUD 65,000.

Note 16:   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

a)             truck driver positions;

b)             fleet manager positions;

c)             container controller positions;

d)             positions in a business that have an annual turnover of less than AUD 1 million;

e)             positions in a business that have fewer than five employees.

Note 17:   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any one of the following:

a)             positions in a business that have an annual turnover of less than AUD 1 million;

b)             positions in a business that have fewer than five employees;

c)             positions that have a nominated base salary of less than AUD 90,000.

Note 18:   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any one of the following:

a)             positions in a business that have an annual turnover of less than AUD 1 million;

b)             positions in a business that have fewer than five employees;

c)         positions that have a nominated base salary of less than AUD 80,000.

Note 19:   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions that predominately involve  responsibility for managing hotel or motel staff.  The specification does not exclude positions that predominately involve responsibility for organising and controlling the operations of a hotel or motel that may have limited duties requiring management of hotel or motel staff but is not the main function of the position.

Note 20:   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes positions that do not require a minimum of two years relevant work experience.

Note 21:   In relation to specifications of occupations for a Subclass 457 – Temporary Work (Skilled) visa, despite paragraph 2 of this instrument, for the purposes of paragraph 2.72(10)(aa) of the Regulations, the specification excludes any of the following:

a)             positions in a business with an annual turnover of less than AUD 1 million;

b)             positions in a business with fewer than five employees;

c)             positions that have a nominated base salary of less than AUD 65,000.

Note 24:   In relation to specifications of occupations for Subclass 186 – Employer Nomination Scheme visa, for the purposes of sub-subparagraph 5.19(4)(h)(i)(A) of the Regulations, indicates that, despite paragraph 6, for an application for approval of a nomination for a Subclass 186 visa, the occupation excludes positions in Fast Food or Takeaway Food Service.
